1. Introduction
These Terms govern services provided by CAPP Productions (“we/us”). By commissioning services, you agree to these Terms.
2. Services
We provide video production services including AI-assisted content, motion, editing, and delivery. The exact scope, deliverables, timeline, revision rounds, and fees will be set out in a Quote/Statement of Work (“SOW”) or Client Agreement.
3. Bookings & scope
A project is confirmed when you accept our Quote/SOW (email acceptance is sufficient) and any required deposit is received. Anything not listed in the SOW is out of scope and may require additional fees.
4. Revisions & change requests
Included revision rounds are defined in the SOW. Additional revisions, new concepts, or major direction changes after approval may be charged separately, agreed in writing before we proceed.
5. Invoices & payment terms
We issue invoices for deposits, milestones, and/or final balances as set out in your Quote/SOW. Work may be paused for overdue invoices. Final deliverables may be withheld until all amounts are paid in full.
6. Intellectual Property & Commercial Usage
All work remains our property until paid in full. Upon full payment, you receive a commercial licence to use the final deliverables as agreed in the SOW. Editable project files/raw files are not included unless agreed in writing. Any third-party assets (music/stock/fonts/tools) are subject to their licence terms.
7. AI tools
Unless agreed otherwise in writing, we use AI-assisted tools in production. You acknowledge AI outputs can be unpredictable and may require iteration. We act in good faith to avoid infringement; however, we cannot guarantee AI-generated content is free from all similarity claims. If you require a non-AI workflow or enhanced clearance, this must be agreed in writing and may affect pricing.
8. Portfolio use
Unless you request confidentiality in writing before delivery, we may showcase finished work in our portfolio and marketing.
9. Cancellations & terminations
Deposits may be non-refundable once work begins, as set out in your Quote/SOW. If you cancel, you remain liable for work completed to date and any committed third-party costs. We may suspend/terminate services for breach (including non-payment).
10. Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect or consequential losses. Our total liability is limited to the fees paid for the relevant project.
11. Governing Law
These Terms are governed by the laws of England and Wales.
12. Priority of documents
If there is any conflict between these Terms and a signed Quote/SOW/Client Agreement, the signed project document will take precedence.
